Mens Rea wrongful state of mind
actus reus an act by the defendent that results in prohibited harm to society
deliberate bodily movement and affermintive action consciously taken by the defendent; distinguished form and unconscious or reflexive act
omission the faliure to act when the law imposes a duty or act
overt act for conspiracy an act committed in furtherance of a conspiracy
overt act for an attempted crime a substantail step toward commision of the intended offense
mere prepparation attempted crimes require that the defendant move beyond preparation and begin consummation of the offense
specific intent the defendant subjectively intends of desires to bring about the prohibited social harm
wanton state of mind extremely reckless disregard of the saftey of others, or of other prohibited consequences
willful state of mind actual knowledge of the threat to anothers saftey, or of other prohibited consequences
reasonably prudent person standard measures the defendants actual conduct against that of a reasonably prudent person under the same similar circumstances
simple or civil negligence occurs when a person fails to act as a reasonably prudent person under the circumstances
recklessness (criminal negligence) the defendents deviation from reasonable conduct is excessive, or more than simple (non criminal) negligence
strict liability crimes defendent commits an act that causes a prohibited harm, regardless of the defendants state of mind.
motive a reason a person does something
factual cause prohibited harm would not have occured when it did in the absence of the defendents conduct
legal causation one of the factual causes identified as the legal significant act that warrants conviction and punishment
