EMPLOYEE RIGHTS LEGISLATION

TITLE VII OF THE CIVIL RIGHTS ACOT OF 1974

prohibits discrimination or segregation based upon race, color, national origin, religion or gender in all terms and conditions of employment

CIVIL RIGHTS ACT OF 1991

expands possible damage awards available to victims of intentional discrimination to include compensatory and punitive damages; gives plaintiffs in cases of alleged intentional discrimination right to a jury trial

AGE DISCRIMINATION IN EMPLOYMENT (ADEA)

prohibits discrimination in employment for persons age 40 and over except where age is a BFOQ

PREGNANCY DISRIMINATION ACT

Amendment to Title VII to prohibit discrimination on the basis of pregancy, childbirth, or related conditions; requires employers to treat pregancy as the same as any other temporary disability

AMERICANS WITH DISABILITIES ACT AND ADA AMENDMENTS ACT (ADA/ADAAA)

prohibits discrimination against a qualified individual with a disability because of his or her disability; protects qualified individuals with disabilities from unlawful discrimination in the workplace, including access to training and career development

GENETIC INFORMATION ACT

prohibits discrimination against individuals on the basis of their genetic information in both employment and health insurance

LILY LEDBETTER FAIR PAY ACT

creates a rolling tine frame for filing wage discrimination claims; retains the 180/300 day time frame outlined in Title VII but allows the clost to renew each time employees receive compensation that is based upon a discriminatory decision by the employer

UNIFORM GUIDELINES ON EMPLOYEE SELECTION PROCEDURES

assist employers in complying with federal regulations prohibiting discrimination

EXECUTIVE ORDER 11246 (EO11246)

prohibits discrimination and requires federal contractors and subcontractos to take positive, results-oriented steps to eliminate employment barrious to women and minorities

VIETNAM ERA VETERANSREADJUSTMENT ASSISTANCE ACT AND JOBS FOR VETERANS ACT

prohibits discrimination against certain veterans by the US government and federal contractors; require affirmative action

REHABILITATION ACT

prohibits discrimination based on physical and mental disabilities; requires employers to make reasonable accommodation unless there is undue hardship; applies to fed. gov. or fed. contractorsw/contracts over $10K; requires affirmative action

IMMIGRATION REFORM AND CONTROL ACT

prohibits discriminationagainst job applicants on the basis of national origin or citizenship; establishes penalties for hiring illegal aliens and requires employers to establish each employee's identity and eligibility to work

WORKER ADJUSTMENT AND RETRAINING NOTIFICATION ACT (WARN)

requires some employers to give a minimum of 60 days' notice if a plant is to close or if mass layoffs will occur

CONGRESSIONAL ACCOUNTABILITY ACT

prohibits discrimination or segration based upon race,color, national origin, religion or gender in all terms and conditions of employment

UNIFORMEND SERVICES EMPLOYMENT AND REEMPLOYMENT RIGHTS ACT

protects the employment, reemployment, and retention rights of persons who serve or have served in the uniformed services
