Someone snitches and said that Ciraolo has weed growing in back yard. Fly over his house and spot the bud. NO WARRANT! no problem if they had warrant.
In light of the search and seizure clause of the 4th amendment as applied to the states through the 14th and KATZ vs. US; do criminal suspects have a reasonable expectation of privacy against warantless police surveillance from public navigable air space?
2-prong test which resolved the KAtz vs. Us. Anybody flying over his house could have spotted his the bud growing in his back yard. no 4th amendment violation
