MPC Choice of Evils
Conduct which the actor believes to be necessary to avoid imminent harm or evil to himself or another is justifiable if:
the harm sought to be avoided is greater than the harm caused and
No law or exception for situation
If negligent or reckless in belief, so defense
A person may not sacrifice another person's life to save his own
Necessity is never a defense to murder
Necessity Common Law
Done to prevent imminent loss of life,
under circumstances where according to ordinary standards of intelligence and morality,
harm to be avoided outweighed the harm caused by the act
