Ex. Welfare programs went to states. Different outcomes in different states. Believe States know best, can use money more efficiently. Reagan was president. Believed Fed. Gov. got to involved and that some of the power needs to go back to the state.
FDR. was president. Times of Great depression Not as distinctive as dual. Federal government and State cooperatively helped and assisted each other between policies or rules
Courts play a huge role in interpreting the law
Looks like cooperative and new federalism combined. Gives states incentive money to do as they please. "Laboratory of democracy" gives states rights to create new policies that the federal government can look at.

Flexible set of powers to pass laws not stated in constitution

Full faith and credit laws
States must recognize official acts of other states, Ex. Adoption, marriage, etc.
Privileges and immunities clause
States that State's cannot discriminate people from different states
National supremacy clause
conflict between national law and state law, constitution is supreme
McCulloch v. Maryland
National bank filled with controversy. 2nd national bank created, more controversy, passed law to tax bank which would run them out of business. Said nat. gov. decided was justifiable expansion of power. Used implied powers.
