how is case law changed?
- By an appellate court reversing the decision on appeal
- By a later court (usually a higher level court) overruling the decision
- By legislation passed by Parliament
What is a case?
- Judges make decisions to resolve real disputes
- The 'case' sets out the solution to the particular dispute between the parties and is known by the names of the parties involved in the dispute
- A series of decisions dealing with the same general topic creates a legal framework of rules on that topic area
- Judges decisions are recorded so that they can be accessed and used when other disputes arise at a later date
