Describe the legislative functions of the president and the federal judiciary. How did these bodies end up with legislative power?
Founders provided for elected officials in the legislature and appointed officials in the judiciary. They believed that freedom, equality, and justice are best achieved by a balance between the two branches of government.

because the President is Commander in Chief of all Armed Forces, yet does not have the power to decide when to go to war. With the War Powers Act the President must inform Congress within 48hrs of sending troops into military action and must receive approval from Congress within 60 days. Congress is reluctant to do this because it is demoralizing to the Presidential office and it puts soldiers' lives at risk who are already at war.
Compare and contrast the formal (on paper) balance of power (what is described in the Constitution) between the three branches of government with the actual balance of power between the three branches today.
Judicial: supreme court has power to declare legislative and executive actions unconstitutional
Executive: congressional delegation of power, war powers, ability to communicate directly with the American people, power to appoint & confirm Supreme Justices
Legislative: make laws (House & Senate)
Divided: control of executive and legislative branch is split between 2 parties
What accounts for these changes? In your opinion, which (if any) of the branches have too much power, and why?
The interpretation of the Constitution throughout the years can account for these changes. What may have been written by the Founders then can be interpreted by each branch of government differently than what the Founder's intended. I think the Judicial branch has too much power, but in a good sense. Justices are to interpret what is written in the constitution and that interpretation of the constitution can be used to check the powers of the other branches of government.

Incumbents are already familiar to voters. Incumbents have already been given the opportunity to prove that they are capable of following through on the promises they made during campaigning.
How are the Senate and House different and why does it matter?
(Power in the House revolves around the Speaker & The Senate has no speaker. This matters because the Speaker determines the House's legislative agenda)
