Poor Man's Copyright
The practice of obtaining copyright protection without filing the appropriate documentation via the U.S. Copyright Office. Most commonly performed by authors who send their work through the postal service or by a notary public to themselves and using a time stamp to validate a date of creation. There is no provision in copyright law regarding such type of protection and courts have rejected such cases as the method is susceptible to tampering.
Trade Secret Protection
Length of protection: perpetual (or until someone discovers the secret lawfully)
Allows holder to sue for violation, if owner can prove:
-Trade secret existed
-Defendant acquired trade secret through unlawful means
-Defendant used trade secret without plaintiff's permission
Remedies for trade secret infringement:
illegally copying or distributing copyrighted material
Unauthorized use of another's mark. The holder may recover damages and other remedies from the person(s) who used the mark without permission.
This is a contract between an employer and an employee that states that the employee will net reveal the employer's trade secrets to future employers.
