Description (Objective/Purpose)
"This course presents the Texas Health and Safety Code Subchapter A, Chapter 181, and the Business and Commerce Code that have been amended by Texas House Bill 300 (HB 300). The sections amended in these codes include medical records privacy, standards for electronic sharing of electronic health records, and personal identity theft. The course will also present the differences between the Texas law and the Federal Health Insurance Portability and Accountability Act and Privacy Standards (HIPAA)."
Learning Objectives
"Describe the differences in the definition of covered entity between HB 300 and HIPAA and how this affects patient notifications. Explain how HB 300 training requirements are more stringent than HIPAA. State the information to be included on the Consumer Information Website and the Complaints Report. Illustrate the constraints surrounding the sale and disclosure of protected health information (PHI). List the penalties, disciplinary action, and audits that may be imposed for violation of PHI disclosure laws. State the requirements of the standards to be developed for electronic sharing of PHI. Describe the requirements and penalties for security breach disclosure and theft of PHI under the Business and Commerce Code."
