Citizenship Clause
14th amendment: all people born in the US are citizens. States cannot control citizenship; federal power.
Commerce Clause
Article 1 Section 8: i regulate commerce with foreign nations, among several states and Indian tribes.
Cruel and Unusual Punishment Clause
8th Amendment: excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted.
Due Process Clause
5th Amendment: no one deprived of life liberty and property without due process- applied to fed gov
14th Amendment: no state can deprive of liberty life and property without due process.
Elastic Clause
(Necessary and Proper Clause)
Article 1 Section 8: Congress has the power to make laws that are necessary and proper for carrying out execution of enumerated powers. Creates implied powers.
Equal Protection Clause
14th Amendment: No state shall deny someone equal protection of the law
Establishment Clause
1st Amendment: congress shall pass no law respecting an established religion.
Free Exercise Clause
1st Amendment: no passing laws prohibiting the exercise thereof
Full faith and Credit Clause
Article 4: full faith and credit is given to each state in the public acts, records, and judicial proceedings of every other state.
Privileges and Immunities Clause
Article 4 and 14th Amendment: the citizens of each state shall be entitled to all privileges and immunities of citizens in other states.
Supremacy Clause
Article 6: The constitution, laws and treaties made by the U.S. Gov shall be the supreme law of the land and judges of each state must follow them.
