Social Contract Theory
The just society is one "based upon principles that arise from an agreement among free and independent persons in an original position of equality"
The Original Position
characterized by the veil of ignorance (no one knows his position in society, nor even his place in the distribution of natural talents and abilities)
veil of ignorance
Ignorance regarding: sex, race, family wealth, social status, health, and religion
prevents anyone from being advantaged/ disadvantaged by the contingencies of social class and fortune
why original position yields the most just distribution?
we cannot choose principles that will favor our own group over others
- rights, liberties, and opportunities
- income and wealth
- any other social bases of self-respect
two principles of justice
1. Equal Liberty- Each person has an equal right to the most extensive liberty compatible with like liberty for all
2. Inequalities are just only if they improve the prospects of everyone in society
a. There must be equal access and opportunity with regard to all positions in society
Inequalities are just if and only if the greater expectations of the ore advantaged improve the expectations of the least advantaged
Why would we choose difference principle if in original position?
Because you don't know your position in society. It's only rational to maximize the minimum position (veil of ignorance)
