If the regulatory transcription factor has bound to the regulatory element, it will affect the transcription of an associated gene, also transcription would be activated it or repressed, that depend on the action of the regulatory protein.

Regulatory elements are located in the upstream region near the promoter, and also they could be located anywhere downstream, even quite far from the promoter.
