It could be argued that in the case of civilians attempting to loot clothing due to not having lost their own clothes from a natural disaster, an officer may choose to reprimand them for the theft and instruct them to return the stolen items. However, rather than detain the civilians, the officer may also decide to help them obtain clothing through more legal means in order to dissuade them from repeating the offense.

At the same time, if civilians were caught looting televisions or other electronics, it would likely be more justified to arrest the offenders. This could be justified by the fact that items such as food or clothing are necessary for basic survival, and thus more likely to be seen as understandable as things to be illegitimately acquired. In contrast, televisions and other appliances are widely seen as amenities or luxuries, and to steal them would be far more likely to implicate the offender of seeking personal gain; a motive that is typically seen as far less acceptable than survival.

One alteration to Rule 3.8 of the *Model Rules of Professional* for attorneys within the United States is that, when informed of new evidence regarding a defendant's conviction status, all prosecutors are meant to actively share such evidence with the rest of the court, including the defendant, and investigate whether the evidence changes the case. Additionally, if further evidence is provided to support the idea that the defendant did not commit a stated offense, the prosecutor is obligated to take steps to correct the situation.

A primary factor to these provisions stemmed from a significant increase in previously convicted citizens later being proven innocent of the charged offenses. In providing these alterations, the most likely goal was to avoid future instances of needing to reexamine cases of wrongful convictions.

Discretion and Dilemmas in Corrections

It could be argued that while the most legal choice for a parole officer to take would be to file a violation against a parolee for using drugs, the circumstances of both the offense and the direct consequences of such an act would also need to be taken into account in order to correctly assess the full situation. For example, a single mother of three children smoking marijuana in order to cope with a lack of support from her family would likely be seen in a different light than another person going through far less severe circumstances.

With this in mind, a parole officer may decide not to file a violation for the single mother, as to do so could be considered to have far more destructive consequences for both the mother and her children. Instead, the officer may elect to seek out services that could effectively address the parolee's emotional distress without relying on illegal drug usage.
